{"id":3821,"date":"2020-04-28T15:29:20","date_gmt":"2020-04-28T13:29:20","guid":{"rendered":"https:\/\/jarzpartner.pl\/?p=3821"},"modified":"2022-09-17T13:34:15","modified_gmt":"2022-09-17T11:34:15","slug":"zawieszenie-dzialalnosci-gospodarczej","status":"publish","type":"post","link":"https:\/\/jarzpartner.pl\/de\/zawieszenie-dzialalnosci-gospodarczej\/","title":{"rendered":"Zawieszenie dzia\u0142alno\u015bci gospodarczej"},"content":{"rendered":"<p><span style=\"color: #000000;\">Z&nbsp;niniejszego artyku\u0142u z&nbsp;cyklu \u201eZ prawem do&nbsp;celu\u201d dowiecie si\u0119 w&nbsp;jaki spos\u00f3b przedsi\u0119biorca wpisany do&nbsp;Centralnej Ewidencji i&nbsp;Informacji o&nbsp;Dzia\u0142alno\u015bci Gospodarczej (dalej jako: <strong>CEIDG<\/strong>) mo\u017ce zawiesi\u0107 dzia\u0142alno\u015b\u0107 gospodarcz\u0105.<\/span><\/p>\n<p><span style=\"color: #000000;\">Przedsi\u0119biorca, kt\u00f3ry z&nbsp;jakich\u015b wzgl\u0119d\u00f3w zamierza zlikwidowa\u0107 swoj\u0105 dzia\u0142alno\u015b\u0107 gospodarcz\u0105 nie musi tego robi\u0107, gdy\u017c mo\u017ce skorzysta\u0107 z&nbsp;przepis\u00f3w Ustawy Prawo przedsi\u0119biorc\u00f3w<a style=\"color: #000000;\" href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> przewiduj\u0105cych zawieszenie wykonywania dzia\u0142alno\u015bci gospodarczej.<\/span><\/p>\n<p><span style=\"color: #000000;\"><!--more--><\/span><\/p>\n<h3><span style=\"color: #000000;\"><strong>Kto mo\u017ce zawiesi\u0107 dzia\u0142alno\u015b\u0107 gospodarcz\u0105?<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">Zgodnie z&nbsp;art. 22 Ustawy Prawo przedsi\u0119biorc\u00f3w uprawnienie do&nbsp;zawieszenia dzia\u0142alno\u015bci gospodarczej przys\u0142uguje przedsi\u0119biorcy, kt\u00f3ry nie zatrudnia pracownik\u00f3w.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ponadto zawiesi\u0107 dzia\u0142alno\u015b\u0107 mo\u017ce przedsi\u0119biorca, kt\u00f3ry zatrudnia wy\u0142\u0105cznie pracownik\u00f3w przebywaj\u0105cych na&nbsp;urlopie macierzy\u0144skim, wychowawczym lub&nbsp;rodzicielskim.<\/span><\/p>\n<p><span style=\"color: #000000;\">Je\u015bli przedsi\u0119biorca wykonuje dzia\u0142alno\u015b\u0107 gospodarcz\u0105 jako wsp\u00f3lnik sp\u00f3\u0142ki cywilnej, to mo\u017ce j\u0105 zawiesi\u0107 w&nbsp;jednej lub&nbsp;kilku takich sp\u00f3\u0142kach.<\/span><\/p>\n<p><span style=\"color: #000000;\">W&nbsp;przypadku zawieszenia dzia\u0142alno\u015bci gospodarczej sp\u00f3\u0142ki cywilnej wymagane jest z\u0142o\u017cenie wniosku przez&nbsp;wszystkich wsp\u00f3lnik\u00f3w.<\/span><\/p>\n<h3><span style=\"color: #000000;\"><strong>Jak zawiesi\u0107 dzia\u0142alno\u015b\u0107 gospodarcz\u0105?<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">W&nbsp;celu zawieszenia wykonywania dzia\u0142alno\u015bci gospodarczej przez&nbsp;przedsi\u0119biorc\u0119 wpisanego do&nbsp;CEIDG konieczne jest z\u0142o\u017cenie stosownego wniosku do&nbsp;CEIDG.<\/span><\/p>\n<p><span style=\"color: #000000;\">Wniosek mo\u017cna z\u0142o\u017cy\u0107 na&nbsp;dwa sposoby:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">przez&nbsp;Internet u\u017cywaj\u0105c podpisu elektronicznego, podpisu potwierdzonego profilem zaufanym lub&nbsp;podpisu osobistego, kt\u00f3ry umo\u017cliwia identyfikacj\u0119 wnioskodawcy (link do&nbsp;wniosku: <a style=\"color: #000000;\" href=\"https:\/\/prod.ceidg.gov.pl\/CEIDG\/CEIDG.Public.UI\/DecisionAdditionalParameters.aspx?type=3\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/prod.ceidg.gov.pl\/CEIDG\/CEIDG.Public.UI\/DecisionAdditionalParameters.aspx?type=3<\/a>);<\/span><\/li>\n<li><span style=\"color: #000000;\">w&nbsp;urz\u0119dzie miasta lub&nbsp;gminy sk\u0142adaj\u0105c wniosek osobi\u015bcie lub&nbsp;przesy\u0142aj\u0105c go listem poleconym.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><strong>Pami\u0119taj!
